Makes changes to the laws regulating microbreweries.
An Arizona licensed Domestic Microbrewery may sell beer produced/manufactured on its premises to be consumed either on or off-site and may make sales and deliveries of the beer to both retailers and wholesalers who are properly licensed by the Arizona Department of Liquor Licenses and Control. Further, the Domestic Microbrewery may serve samples of beer.
Following the first year, annual production must equal at least 10,000 gallons of beer, limited to the production of 300,000 gallons per year. Any retail operations must be conducted at the site of the microbrewery, which may sell other spirituous liquor if the business holds an on-sale retail license, and the liquor sales are on or adjacent to the microbrewery. Any person with a Domestic Microbrewery license may also possess other on-sale retail licenses if the person is not otherwise a vintner, distiller, brewer or other producer of spirituous liquor; however, the person must purchase all spirituous liquor to be sold at the other on-sale retail premises from licensed Arizona wholesalers.
· Eliminates the authority for a licensed Domestic Microbrewery to sell and deliver beer to persons licensed to sell beer, including licensed wholesalers.
· Increases the amount of beer a Domestic Microbrewery may produce annually to 930,000 gallons.
· Permits a Domestic Microbrewery to distribute products that are produced at the person’s own microbrewery only to the person’s retail licensees.
· Allows a licensed producer to sell distilled spirits in addition to beer.
· Re-authorizes and extends the transfer of liquor licenses between counties with a population of 500,000 or more persons to counties with a population of less than 500,000 persons (between July 1, 2007 and December 31, 2008).
