AN ACT
Authorizing the department of transportation to provide organ donor information.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Department of transportation; organ donor information; transfer deadline; civil liability
A. The department of transportation may transfer any executed documents of gift recorded on a person's driver license or nonoperating identification license that the department of transportation received pursuant to section 28-422.03, Arizona Revised Statutes, as repealed by Laws 1996, chapter 333, section 2, to an organ procurement organization that is located in this state, that meets the requirements of section 371 of the public health service act (42 United States Code section 273) and that maintains an anatomical gift registry established pursuant to section 36‑842.01, Arizona Revised Statutes.
B. The transfer of documents shall be completed by June 30, 2006.
C. The department of transportation is not subject to civil liability as a consequence of good faith acts or omissions relating to the gathering and release of information to the anatomical gift registry. All acts and omissions are presumed to be in good faith unless the acts or omissions are done with gross negligence or intent to maliciously cause injury.
Sec. 2. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
