driver license revocation; suspension; accidents

 

 

Purpose

 

Increases the penalties for leaving the scene of an accident.

 

Background

 

Current law specifies a class 3 felony for a person who causes a serious injury or fatal accident and leaves the scene of the accident, a class 4 felony if a person who was involved in a serious injury or fatal accident left the scene of the accident, but did not cause the accident, and a class 6 felony for a person who leaves the scene of an injury accident, other than serious injury or death.  A person who leaves the scene of an accident involving damage to the vehicle, is guilty of a class 3 misdemeanor.  MVD is required to revoke the driving privilege for a person convicted of leaving the scene of an injury, serious injury or fatal accident for one year. 

 

There is no known impact to the state general fund associated with this legislation.

 

Provisions

 

1.      Revokes the driving privilege of a person convicted of leaving the scene of a fatal or serious injury accident for five years.

 

2.      Revokes the driving privilege of a person convicted of leaving the scene of an injury accident, other than death or serious injury, for three years.

 

3.      Requires that a sentence for leaving the scene of an injury, serious injury or fatal accident run consecutively with any other sentence related to the accident.

 

4.      Allows the court to order ADOT to suspend the driving privilege of a person convicted of leaving the scene of an accident involving damage to the vehicle for one year.

 

5.      Makes conforming changes.

 

6.      Provides for a general effective date.
