SUBJECT: Strike Everything Amendment
to H.B. 2485 (schools; instructional programs;
hour requirements)
Allows the State Superintendent to allow a common school district that meets specified criteria to correct state aid errors or budget limit errors made in FY 1999-2000 in a period of no more than four years after the miscalculation is determined and makes a change to the budget format submitted to the Arizona Department of Education (ADE).
Current law requires the State Superintendent to require a school district or charter school to correct any budget errors if it is determined that the calculation of state aid or the budget limit for a school district or charter school did not conform with statutory requirements. Additionally, the corrections may be made by the school district or charter school in the current year or in the budget year. If a school district or charter school experiences a hardship in making the correction in the budget, the State Superintendent may approve that corrections can be made partly in one year and partly in the following second year.
The strike everything amendment to H.B. 2485 provides for an exemption to this law for Kirkland Elementary School which was overpaid approximately $94,000 by the ADE in FY 1999-2000. The school anticipates that the school district will need additional time beyond the two years, as required in statute, to correct the budget and reimburse the State for monies due as a result of the overpayment of monies during FY 1999-2000.
Any fiscal impact to the state general fund associated with this bill is unknown at this time. A fiscal estimate from Joint Legislative Budget Committee staff has been requested.
