Changes the self-inspection program for moving livestock from one location to another to a mandatory program, if the Director adopts rules to implement the program.
Current statute authorizes the Director of the Department of Agriculture (Department) to exercise general supervision over the livestock interests of the state; including the authority to adopt, by rule, a self-inspection program for moving livestock from one location to another in this state. Currently this program is not mandatory, but the associate director of the Department monitors compliance with the requirements of the self-inspection program and completes periodic examinations of self-inspection records.
The Director may, with just cause, suspend the self-inspection privileges of feedlots, dairies and producers, and any person who knowingly violates the requirements of the self-inspection program must be placed on administrative probation for a period of one year. Subsequent violations during probation are subject to a civil penalty of $200 per violation and revocation of self-inspection privileges for a period of three years.
In response to the budget cuts of the Second Special Session of 2001, H.B. 2363 reduces the Department’s inspection workload by making the self-inspection program for moving livestock from one location to another mandatory, and removing the requirement that the self-inspection program be limited to livestock moving within this state. Additionally, it provides for the private treaty sale of self-inspected livestock.
There is no known fiscal impact to the state general fund relating to the provisions in this bill.
1. Changes the self-inspection program to a mandatory program, if the Director adopts rules to implement the program.
2. Removes the requirement that the self-inspection program be limited to livestock moving within this state.
3. Limits the issuance of seasonal inspection certificates for exhibition livestock to the self-inspection program. Previously, seasonal inspection certificates could only be issued by a livestock inspector.
4. Allows the Department to provide for the private treaty sale of self-inspected livestock.
5. Clarifies that business records verifying the shipment or sale of livestock are subject to periodic examination by the associate director.
6. Permits the Director, with just cause, to modify the self-inspection authorization of feedlots, dairies and producers.
7. Excludes dairy calves under 30 days of age from the requirement that a bill of sale accompany the animals for delivery.
8. Makes technical and conforming changes.
9. Provides for a general effective date.
