bad checks; notice
Adds two methods of mail delivery that a bad check recipient of can use to notify the check’s issuer.
Current law states that a person who receives a bad check may give notice to the issuer requesting payment using a form prescribed by state law. The notice must include the name and address of the issuer, the number, amount and date of the check, the holder of the check and the consequences of non-payment. Written notice must be sent via registered mail with return receipt requested to the address of the issuer that is found on the check, bank records or the check holder’s records.
This measure stipulates that a written bad check notice must be mailed by registered mail with return receipt requested, by certified mail with return receipt requested or by regular mail with an affidavit of service by mailing.
There is no anticipated fiscal impact to the state general fund associated with this bill.
1. Allows the recipient of a bad check to send notice to the issuer via certified mail with return receipt requested or by regular mail that is supported by an affidavit of service by mailing.
2. Contains technical changes.
3. Provides for a general effective date.
