adoption fees

 

Purpose

 

Eliminates filing fees in adoption cases and contested adoptions.

 

Background

 

Under current Arizona law, a $30 filing fee must be paid to the clerk of the court in adoption proceedings. In addition, any person contesting an adoption must pay a $15 fee. 

 

There is a small fiscal impact with this bill. According to the Administrative Office of the Courts, there are approximately 1,200 adoptions filed annually, of which approximately 500 are filed by the Department of Economic Security. In FY 2000-2001, adoption filing fees generated almost $35,000.  Filing fees are distributed to nine specified programs.

 

Provisions

 

1.      Eliminates the $30 fee for filing an adoption case.

 

2.      Eliminates the $15 fee for contesting an adoption.

 

3.      Makes technical changes.

 

4.      Provide for a general effective date.
