FACT SHEET FOR H.B. 2113

Purpose

 

Expands the purview of the Human Rights Committee on the Mentally Ill (Committee) to include all persons who receive behavioral health and substance abuse services.

 

Background

 

Laws 2000, Chapter 261, established the Committee to promote the rights of persons receiving mental health services and required each regional behavioral health authority to have at least one human rights committee with the authority and responsibilities as prescribed by the Department of Health Services (DHS). The Committee reviews incident and accident reports and monitors the mental health treatment system from an external standpoint.

 

According to the Division of Behavioral Health Services in DHS, the enabling legislation was intended to include all individuals receiving behavioral health treatment. However, it only included persons with a serious mental illness (SMI). DHS later included children and adolescents through rule, but non-SMI persons were not included. As such, DHS cannot share incident and accident reports concerning non-SMI persons with the Committee for review. H.B. 2113 expands the purview of the Committee to include all individuals receiving behavioral health and substance abuse services.

 

There is no identifiable fiscal impact to the state general fund associated with the provisions of this bill.

 

Provisions

 

1.      Expands the purview of the Committee to include persons who receive behavioral health and substance abuse services.

 

2.      Becomes effective on January 1, 2004.
