Continues the waste tire program and the tire fee until Dec 31, 2007.
In 1990, the Legislature established the waste tire program to address problems relating to the proper handling and disposal of waste tires (Laws 1990, Chapter 389). That legislation prohibited the disposal of waste tires in landfills or by incineration and imposed a fee on the purchase of new tires in the state of 2 percent of the price of the tire, but not more than $2 per tire. This fee is collected by the retail and wholesale tire sellers in the state and is deposited in the waste tire fund, which is administered by the Arizona Department of Revenue (DOR). The monies in the fund are distributed by DOR to the counties in proportion to the number of vehicles registered in that county as of the preceding July 1. The counties are required to use the monies from the fund for the operation of a waste tire program. In addition, the Arizona Department of Environmental Quality (ADEQ) receives up to 3.5 percent of the waste tire fees collected for monitoring and enforcement of waste tire disposal requirements, and up to 5 percent, not to exceed $250,000, for tire fire clean up expenses if no other funds are available.
The 1990 legislation included a repeal of the waste tire program and the new tire fee on December 31, 1995. In 1995, the Legislature continued the program and fee through December 31, 1997. In 1997, legislation was passed to extend the program and fee to December 31, 2002.
H.B. 2120 continues the waste tire program and the new tire fee until Dec 31, 2007.
There is no known impact to the state general fund relating to the provisions of this bill.
