The Water Quality Appeals Board (WQAB) hears appeals on decisions made by the Arizona Department of Environmental Quality (ADEQ) to grant, deny or modify individual water quality permits, as well as decisions on pesticide regulation and standards. The decisions of the WQAB are subject to appeal to the superior court. The Office of Administrative Appeals is also authorized to hear appeals of decisions made by ADEQ (A.R.S. 41-1092.01).
The Water Quality Appeals Board was established in 1986 within the Department of Administration and consists of three members appointed by the governor to terms of three years. One member of the board must be an attorney licensed to practice law in this state and all members must possess technical competence to perform the duties of the board.
A sunset review hearing for the WQAB was conducted on November 8, 2001. The Committee of Reference voted to continue the WQAB for ten additional years. H.B. 2101 continues the WQAB until July 1, 2012.
According to JLBC, in FY
2001-2002 the Water Quality Appeals Board general fund appropriation was
$10,000.
1. Extends the termination date of the Water Quality Appeals Board from July 1, 2002 to July 1, 2012.
2. Provides for a retroactive effective date.
