Purpose

 

An emergency measure that allows the Director of the Department of Agriculture to sell products labeled with the “Arizona Grown” trademark.      

 

Background

 

Within the Arizona Department of Agriculture (Department), the Office of Commodity Development and Promotion is charged with developing programs to encourage the consumption and production of Arizona agricultural products.   As part of this effort, the Office of Commodity Development and Promotion is currently producing promotional materials for Arizona agriculture with the “Arizona Grown” logo.   However, the Director of the Department is not authorized to sell these materials. 

 

H.B. 2060 allows the Director of the Department to sell materials with the “Arizona Grown” trademark, and requires that the proceeds be deposited in the commodity promotion fund.   This fund is continuously appropriated to the Department for stimulating the production and consumption of Arizona agricultural products.

 

            There is no known fiscal impact to the state general fund relating to the provisions of this bill.

 

Provisions

 

1.      Allows the Director of the Department to sell, exchange and dispose of products labeled with the “Arizona Grown” trademark.

 

2.      Requires that monies from the sale of “Arizona Grown” products be deposited in the commodity promotion fund.          

 

3.      Requires the Director of the Department to administer the commodity promotion fund, including directing the State Treasurer to invest and divest monies in the fund and credit interest earnings to the fund.

 

4.      Makes technical changes.

 

5.      Becomes effective on signature of the Governor.
