Prohibits a public education body from denying its employees of an opportunity to contribute to a nonprofit organization because of the organization’s beliefs, expressions or exercise of rights.
Public employees are provided opportunities to donate a portion of their income to charitable organizations. Donations may be made by employees to support local, national or international health and human service agencies through such voluntary payroll deductions. Public bodies may, based on stipulated requirements of that public body, present to its employees selected charities for which contributions can be made.
S.B. 1324 prohibits a public education body from denying its employees of an opportunity to contribute to a nonprofit organization because of the organization’s beliefs, expressions or exercise of rights. Public bodies, as defined in the bill, include universities, community colleges, community college districts, school districts, charter schools or state or public supported schools.
There is no discernible fiscal impact to the state general fund associated with this bill.
1. Prohibits a public education body from denying its employees of an opportunity to contribute to a nonprofit organization because of the organization’s beliefs, expressions or exercise of rights of association that are constitutionally protected.
2. Stipulates that a public body is not prohibited from using existing standards or requirements for determining if a nonprofit organization is a charitable organization.
3. Prohibits public monies from being appropriated to any public body in violation of this act.
4. Defines “nonprofit organization” and “public body.”
5. Provides for a general effective date.
