SUBJECT:       Strike Everything Amendment to S.B. 1281

                                                                                                                                                           

 

Purpose

 

            Assesses $371,820 against the public service corporations that operate the Palo Verde nuclear generating station to reimburse the State of Arizona for the cost of providing Arizona National Guard resources for security at the station.

 

Background

           

On September 12, 2001, the Governor declared a state of emergency and allowed the Adjutant General to mobilize the National Guard as it determined necessary to assist in the protection of life and property throughout the State.   Upon declaration of an emergency, specific expenses are authorized to be paid from unrestricted monies from the state general fund, including expenses to mitigate and meet contingencies arising from invasions or hostile attacks (ARS 35-192).

 

From October 30, 2001 to November 16, 2001, the Governor spent monies from the state general fund to provide Arizona National Guard security to the Palo Verde nuclear generating station.

           

The strike everything amendment to S.B. 1281 assesses $371,820 against the operators of the Palo Verde nuclear plant, in order to reimburse the State of Arizona for the cost of providing National Guard resources for security at Palo Verde nuclear plant from October 30, 2001 to November 16, 2001.

 

            This amendment will increase the state general fund monies by $371,820.

 

Provisions

 

1.      Assesses $371,821.47 against the consortium of public service corporations operating the Palo Verde nuclear generating station.   

 

2.      States that the purpose of the assessment is to reimburse the State of Arizona for costs incurred while providing National Guard resources for security at the Palo Verde nuclear generating station from October 30, 2001 to November 16, 2001.

 

3.      Provides for a general effective date.
