Removes, from the conditions established for transferring state land to the Arizona Board of Regents (ABOR), the requirement that the title or patent of lands transferred ensures that all rights, title and interest in the lands revert back to the State if the ABOR desires to or relinquishes ownership or control of the transferred lands and decides not to use ASU West Campus lands.
Development of Arizona State University (ASU) West began in 1982, and there are approximately 6,000 undergraduate and graduate students currently enrolled at the university. In the Fall of 2001, ASU West began admitting freshmen level students for the first time, beginning the transition to a four-year university.
In 1982, the Legislature approved approximately 300 acres of state trust land located in Maricopa County to the ABOR for the development of the ASU West campus on the Southwest corner of 43rd Avenue and Thunderbird Road. The legislation included deed restrictions to ensure that the ASU West campus would be built on this designated parcel of land. As part of the land transfer agreement, the Legislature required the ABOR, having oversight of the ASU West campus development, to ensure that the title or patent of the general revenue lands being transferred to the ABOR contained a covenant or restriction that all rights, title and interest in the lands revert back to the state if for any reason the ABOR:
a) desires to or relinquishes their ownership or control of the lands being transferred, and
b) decides not to eventually use the lands consisting of approximately 300 acres for a western campus of ASU.
In 1984, when the ASU West campus was established, the deed restrictions were not removed from statutory references. S.B. 1205 removes these deed restrictions.
There is no discernible fiscal impact to the state general fund associated with this bill.
1. Removes, from the conditions established for transferring state land to the ABOR, the requirement that the title or patent of lands transferred ensures that all rights, title and interest in the lands revert back to the State if the ABOR: (a) desires to or relinquishes ownership or control of the transferred lands, and (b) decides not to use ASU West Campus lands.
2. Provides for a termination and disclaimer of reversion interest for state lands to the ABOR.
3. Makes conforming changes.
4. Provides for a general effective date.
