smoking; university buildings; prohibition

 

Purpose

 

Requires the Board of Regents to require universities to comply with statutory laws that prohibit smoking in state buildings.

 

Background

 

In 1991, the Legislature prohibited smoking in any building owned or directly leased by the State.  If drifting smoke becomes noticeable in an adjoining smoking area and a written complaint is filed, the Director of the Department of Administration and the director of the state agency must make an effort to reduce drifting smoke or prohibit smoking altogether if efforts to contain drifting smoke fail.  Statute prescribes a petty offense for a person who violates statute regarding smoking in state buildings (Laws 1991, Chapter 284).

 

University residence halls in state universities are owned by the university and are, therefore, considered public buildings; however, residence halls are exempted from the law because rooms are leased to individual students and are considered private space.

 

There is no fiscal impact to the state general fund associated with this legislation.

 

Provisions

 

1.      Requires the Board of Regents to require universities to comply with statutory laws that prohibit smoking in state buildings.

 

2.      Makes a technical change.

 

3.      Provides for a general effective date.
