Purpose
Changes
the requirements for gasoline vapor recovery system certification, and requires
that all gasoline vapor recovery system components be permanently identified.
Background
When a stationary or
automobile gas tank is filled, the gasoline entering the tank pushes out vapors
from the empty portion of the tank.
These gasoline vapors, or volatile organic compounds, contribute to
ozone air pollution. Gasoline vapor
recovery systems reduce the escape of volatile organic compounds by collecting
the vapors that would otherwise be released into the air. Stage one gasoline vapor recovery systems
inhibit vapor release when gasoline is transferred from tanker trucks into
stationary tanks, and stage two vapor recovery systems inhibit the release of
vapors when gasoline is transferred from stationary tanks into automobile
tanks.
Current statute states that
only those gasoline vapor recovery components and systems that are certified by
the California Air Resources Board (CARB) may be sold, installed or used in
Arizona. On April 1, 2001, CARB
introduced more stringent standards for gasoline vapor recovery systems and
decertified previously approved systems until further review. According to the Department of Weights and
Measures, most existing gasoline vapor recovery systems are no longer legal for
use in Arizona.
S.B.
1131 allows the use, sale and installation of vapor recovery systems that were
certified by CARB before the new California standards were implemented, and any
vapor recovery systems that may be approved by CARB in the future.
There is no known fiscal
impact to the state general fund relating to the provisions of this bill.
Provisions
1. Changes the requirements for gasoline vapor recovery components and systems sold, installed or used in Arizona to components and systems certified by CARB as of March 31, 2001, or certified after that date, and not rejected by the Arizona Department of Weights and Measures.
2. Requires all certified vapor recovery components and systems to have a permanent identification affixed by their manufacturer or rebuilder.
3. Requires the Department of Weights and Measures to maintain a list of approved vapor recovery components and systems, rather than a list of vapor recovery system design and performance standards. Stipulates that only approved vapor recovery components and systems may be sold, installed or used in Arizona.
4. Allows, rather than requires, retail sellers of motor fuel to equip fuel nozzles with a hold-open latch.
5. Makes technical and conforming changes.
6. Provides for a general effective date.
