Requires planning and zoning bodies to notify and consider recommendations from school districts and the School Facilities Board regarding school capacity when adopting or amending general and comprehensive plans.
The purpose of zoning is to establish land use classifications dividing the city or county into various zoning districts by providing regulations, prohibitions and restrictions to conserve and promote the public health, safety and general welfare. State statute requires a public hearing and specifies notice requirements for adoption of a county plan or municipal zoning ordinance. The local planning commission or hearing officer is required to hold a hearing on any zoning ordinance. Notice of the hearing is published in the local newspaper and is posted on the property of the proposed zoning district.
This measure also requires planning and zoning bodies to consider student count projections and the current or future availability of classroom facilities when considering adoption or amendments to the general and comprehensive plans or rezoning of land.
There is no fiscal impact to the state general fund associated with this legislation.
1. Requires municipality or county zoning and planning bodies to review recommendations from the school district superintendent, school district board and the School Facilities Board regarding student count projections and the current or future availability of classroom facilities to indicate properly located sites for all public purposes on general and comprehensive plans.
2. Requires the governing bodies to submit a copy of the plan or amendment, at least 60 days before adoption, to the superintendent of each school that is affected by the proposal.
3. Requires a municipality or county to send copies of the notice of public hearing, at least 15 days before the hearing, to the school district for proceedings involving rezoning of land located within or adjacent to a school district.
4. Blends multiple enactments relating to the powers and duties of the School Facilities Board.
5. Provides for a general effective date.
