FACT SHEET FOR S.B. 1104

 

liquor donations; charitable auctions

 

 

Purpose

 

Expands the types of alcohol allowed for sale at a charitable wine auction to include any type of alcohol and eliminates the fee for the special event license authorizing such an auction.

 

Background

 

Under current law, the Director of the Department of Liquor Licenses and Control (Department) may issue a temporary off-sale special event license to qualified organizations for the purpose of holding a charitable wine auction for the sale of vintage wines (wines bottled more than ten calendar years before the date of sale) for consumption off event premises.  The fee for the license is $25 per day.

 

Currently, some charitable organizations are holding charitable auctions where alcohol, instead of vintage wine, has been donated and auctioned to benefit the charitable organization.  S.B. 1104 removes the requirement that the charitable auction include only the sale of vintage wines and eliminates the off-sale special event license fee.

 

The Department has not issued any off-sale special event licenses for charitable wine auctions to date, but has issued on-sale special event licenses totaling $30,725 in FY 2001 and $34,650 in FY 2000.  Since S.B. 1104 eliminates the license fee and the requirement that the fees be transferred to the Department of Health Services (DHS), a negative fiscal impact to DHS is anticipated.

 

Provisions

 

1.      Expands the types of alcohol authorized for sale at a charitable auction from vintage wines to any alcohol.

 

2.      Eliminates the fee for an off-sale special event license authorizing a charitable auction. (Currently, the fee for the license is $25 per day.)

 

3.      Eliminates the requirement that the Director transfer monies collected from fees for the off-sale special event licenses to DHS for evaluation and treatment of persons impaired by alcoholism.

 

4.      Eliminates the definition of a “vintage wine”.

 

 

 

 

 

5.      Makes technical and conforming changes.

 

6.      Provides for a general effective date.
