ARIZONA STATE SENATE

FACT SHEET FOR S.B. 1076

private investigator personal information; redaction

Purpose

            Allows a licensed private investigator to request that the presiding superior court judge prohibit access to the investigator’s personal information contained in public records and voter registration records.

Background

            Statute allows some individuals, such as certain law enforcement and justice system employees and people in possession of orders of protection, to request the superior court to prohibit public access to personal information in government records if blocking personal information will reduce the potential for endangerment.  Blocked information can include residential address, telephone number and voting precinct number.  S.B. 1076 allows the superior court to block private investigators’ personal information contained in government records if so requested by the individual.

Any potential fiscal impact on the state general fund is undetermined at this time.

Provisions

1.      Extends to a private investigator the ability to have county records and voter registration records sealed from public access if the person demonstrates that such restriction will provide personal safety.

2.      Blends two versions of laws related to public records that were enacted by Laws 2001.

3.      Makes technical and conforming changes.

4.      Provides for a general effective date.
