Purpose

 

An emergency measure that makes changes to the FY 2001-2002 state budget as amended by the 45th Legislature, Second and Third Special Sessions.

 

Provisions

 

Education

 

1.      Appropriates an additional $2 million from the state general fund in FY 2001-2002 to the Department of Education for basic state aid.

 

2.      Disqualifies unified school districts from receiving new school facilities funding for high school space approved after December 31, 2001, unless that district already has a high school or the district qualifies for geographic exemption factors.

 

Criminal Justice

 

3.      Appropriates an additional $4 million to the Department of Corrections (ADC) in FY 2001-2002 from the corrections fund for health care costs.

 

4.      Reduces the FY 2001-2002 lump sum reduction to ADC by $600,000.

 

5.      Permits the time served by an inmate in county jail prior to his/her incarceration in state prison to be used in calculating good time credit served for early release programs.

 

6.      Reduces, from $785,000 to $185,000, FY 2001-2002 corrections fund support for the construction of Department of Juvenile Corrections medical unit.

 

Health and Welfare

 

7.      Allocates an additional $3.5 million in county acute care contributions in FY 2001-2002 for the provision of hospital and medical care services by the Arizona Health Care Cost Containment System (AHCCCS).  These monies are offset by a $3.5 million state general fund reduction for these services.


 

8.      Reduces FY 2001-2002 state general fund support for AHCCCS acute care by $1.1 million to reflect a surplus savings in the federal emergency services program.  Reappropriates the $1.1 million to AHCCCS for the state emergency services (SES) program to pay for doctor and clinic provider claims for SES enrollees.  (Monies may not be used for inpatient or outpatient hospital reimbursement.)

 

9.      Increases FY 2001-2002 state general fund support of the Department of Economic Security (DES) by $1.1 million for Adoption Services and $1.2 million for General Assistance.

 

10.  Requires DES to deposit $2.4 million of prior year health and dental reimbursements into the state general fund by May 15, 2002.

 

11.  Increases FY 2001-2002 support for the Osteopathic Examiners Board by $29,000 from the Board of Osteopathic Examiners fund.

 

State Employee Military Duty

 

12.  Authorizes, effective September 11, 2001 to June 30, 2004, a state employee or officer who is in the military reserves or national guard and who is ordered to active duty due to a declaration of a state of emergency to receive the difference between the employee or officer’s regular state pay and military pay if all annual and military leave balances have been exhausted.

 

13.  Limits the receipt of the pay differential to 270 days once during a five-year period.

 

14.  Requires military allowances to be included when calculating the officer or employee’s military pay.

 

15.  Prohibits the employee or officer from accruing annual leave or sick leave during the period of active service.

 

16.  Requires military service qualifying for the pay differential to be honorable.

 

Miscellaneous

 

17.  Appropriates $2.7 million from the state general fund to the State Land Department in FY 2001-2002 for suppression of wild land fires and support of other unplanned all risk activities.

 

18.  Allocates $75 million in FY 2002-2003 for first year payments and costs associated with Ladewig v. State of Arizona. Permits the Department of Revenue (DOR) to expend up to $15 million for the purposes of administration and review of payments.  Requires DOR to present an expenditure plan to the Joint Legislative Budget Committee for approval before making this expenditure.

 

19.  Makes technical, clarifying and conforming changes.

 

20.  Becomes effective on signature of the Governor.

1.      Makes various changes to the provision authorizing the receipt of a military pay differential, such as including allowances in the calculation of military pay and eliminating a requirement that an employee or officer be ordered to active service for a minimum number of days before being eligible for the pay differential.

 

2.      Adds the $2.7 million appropriation to the State Land Department in FY 2001-2002 for suppression of wild land fires.

 

3.      Allocates $75 million in FY 2002-2003 for first year payments and costs associated with Ladewig v. State of Arizona, of which $15 million may be used for administrative expenses.
