SCR 1010 proposes an amendment to the Constitution of Arizona regarding the time period that the governor has to sign or veto bills and the procedures following the governor’s veto.  This measure is subject to voter approval at the next general election.

 

Current Status

SCR 1010 was amended in the Military, Veterans’ Affairs & Aviation Committee to increase the time that the governor has to sign or veto a bill while the legislature is in session and after the legislature has adjourned, and stipulates that the legislature can re-consider a vetoed bill during a special session as long as it is within thirty days of the time that the bill was transmitted by the secretary of state.  The Military, Veterans’ Affairs & Aviation amendment was adopted in the Committee of the Whole. 

 

History

The Constitution of Arizona currently allows the governor five days to sign or veto a bill that has been presented to the governor while the legislature is in session.  If the legislature by its final adjournment prevents the bill from being returned, the governor has ten days to file the veto with the secretary of state to prevent the bill from becoming a law. If the bill is vetoed by the governor and presented to the secretary of state after final adjournment of the legislature, it does not become law and the legislature does not have the opportunity to reconsider the bill.

 

Provisions

·          Increases the time period that the governor has to sign or veto a bill while the legislature is in session from five to ten days. 

·          Increases the time period that the governor has to sign or veto a bill after the legislature has adjourned from ten to twenty days.

·          Allows the legislature to override a veto by the governor within the first four days of the next meeting of the legislature after the veto was issued, if the veto was issued after final adjournment of the legislature.

·          Directs the Secretary of State to submit this proposition to the voters at the next general election. 

 

Amendments

SCR 1010 was amended in the Military, Veterans’ Affairs & Aviation as follows:

·          Increases the time that the governor has to sign or veto a bill while the legislature is in session from ten to fifteen days.

·          Increases the time that the governor has to sign or veto a bill after the legislature has adjourned from twenty to thirty days.

·          Stipulates that the legislature can re-consider a vetoed bill, if the legislature calls itself into a special session as allowed in the Arizona Constitution, so long as it is within thirty days of the time that the bill was transmitted by the secretary of state.
