SB 1288 permits a confidential intermediary to contact a person who is at least 18 years old if the adoption was completed before April 1, 1993.

 

History

Laws 1992 authorized the Arizona Supreme Court to administer and implement the Confidential Intermediary Program and caused the program to become effective April 1, 1993.  A confidential intermediary works as a liaison between birth families, adoptive families and adoptees (an adopted person) and has the authority to inspect documents pertaining to adoption, including court records, division records, and other related records.  The intermediary uses the confidential information to arrange contact or share information between persons who initiate the search and those persons who are subject of the search.   

 

Currently, an intermediary is prohibited from contacting a person who is under 21 years of age, with the exception of adoptive parents of an adoptee who is at least 18 years of age.  SB 1288 allows for a confidential intermediary to contact persons who are at least 18 years of age if the adoption was completed prior to April 1, 1993.

        

Provisions

·          Allows a confidential intermediary to contact a person involved with an adoption if the person is at least 18 years of age and the adoption was completed before April 1, 1993.
