SB 1252 authorizes the superintendent of public instruction to enter into compacts with adjacent states for the purpose of allowing admission to Arizona school districts of Native American pupils that reside in a reservation adjacent to Arizona.

 

History

Current Law (A.R.S §15-823) allows for school districts to “exchange” students across state boundaries through tuition based arrangements.  SB 1252 allows funding the admission of Native American pupils that reside in an adjacent state through the Basic State Aid, instead of the tuition based arrangements.

 

Provisions

·          Authorizes the superintendent of public instruction to enter into compacts with adjacent states for the admission of students who are residents of Native American reservations located in both Arizona and a border state.

·          Specifies that the per pupil state expenditure for pupils admitted to an adjacent state under the compact shall not exceed the Arizona average per pupil cost.

·          Clarifies that a pupil admitted to a school district in an adjacent state pursuant to a compact shall be considered resident of the school district that the pupil attends.

·          Contains a repeal date of June 30, 2006.
