SB 1214 makes escaping from the Arizona State Hospital a Class 2 misdemeanor (up to 4 months jail/up to$750 fine) for certain persons.

 

History

Currently, escaping or attempting to escape from a juvenile secure care facility, a juvenile detention facility, an adult correctional facility or from custody imposed as a result of being arrested, charged with or found guilty of a felony is a Class 5 felony (1.5 years prison/$150,000 fine).

 

Provisions

·          Stipulates that escaping or attempting to escape from the Arizona State Hospital is a Class 2 misdemeanor if the person was committed for treatment for any of the following:

·          Outpatient or inpatient juvenile competency restoration program.

·          Legal insanity.

·          Involuntary confinement for a mental examination.

·          Outpatient competency restoration treatment.

·          Voluntary or involuntary hospitalization for a mentally disordered prisoner.

·          Confinement as a sexually violent person.

·          Incompetence.
