SB 1205 removes some conditions established for transferring state land to the Arizona Board of Regents (ABOR).

 

History

Development of Arizona State University West campus (ASU West) began in 1982.  There are approximately 6,000 undergraduate and graduate students currently enrolled at the university.  In the Fall of 2001, ASU West began admitting freshmen level students for the first time, beginning the transition to a four-year university.

 

In 1982, the Legislature approved approximately 300 acres of state trust land located in Maricopa County to ABOR for the development of the ASU West campus on the Southwest corner of 43rd Avenue and Thunderbird Road.  The legislation included deed restrictions to ensure that the ASU West campus would be built on this designated parcel of land.  As part of the land transfer agreement, the Legislature required ABOR to have oversight of the ASU West campus development.  Ensuring that the title or patent of the general revenue lands being transferred to the ABOR contained a covenant or restriction that all rights, title and interest in the lands revert back to the state if for any reason ABOR:

·          Desires to or relinquishes their ownership or control of the lands being transferred, and

·          Decides not to eventually use the lands consisting of approximately 300 acres for a western campus of ASU. 

Construction on the ASU West campus began in 1984. 

 

Provisions

·          Removes the conditions established for transferring state land to ABOR including:

·          The title or patent of the general revenue lands being transferred to ABOR containing a covenant or restriction that all rights, title and interest in the lands revert back to the state if for any reason ABOR desires to or relinquishes their ownership or control of the lands being transferred or if ABOR decides not to eventually use the lands for a western campus of Arizona State University.

·          Terminates and disclaims any reversionary interest in lands conveyed by the State Land Department to ABOR.

·          Prohibits ABOR from selling or conveying title to this particular piece of land.  ABOR is allowed to lease, license or otherwise authorize the use of the lands, and all revenues shall be used solely for education and education related purposes at the ASU West campus.

·          Makes technical and conforming changes.
