SB 1143 requires hearing officers be given preference when Justices of the Peace (JP) pro tempore are being assigned, allows hearing officers to be compensated for mileage expenses and authorizes hearing officers and JPs pro tempore to perform marriage ceremonies.

SB 1143 passed the Retirement and Government Operations Committee unamended.

 

History

According to A.R.S. §22-121, JP pro tempore may be appointed where needed by the presiding judge of the superior court in a county.  These appointments are subject to the approval by the county board of supervisors.  The period of time cannot exceed six months for any one term. 

 

A.R.S. §22-506 does not specify that hearing officers may be compensated for the mileage expenses.  A.R.S. §11-603 includes fees and mileage as expenses of maintaining government. 

 

A.R.S. §25-124 permits duly licensed or ordained clergymen, judges of courts of record, municipal court judges, JPs, justices of the United States Supreme Court, judges of courts of appeals, district courts, and courts that are created by an act of Congress, bankruptcy court and tax court judges, United States magistrate judges, and judges of the Arizona Court of Military Appeals to perform marriage ceremonies. 

 

Provisions

·          Adds that when appointing a JP pro tempore, the presiding judge shall give preference to a hearing officer who has served ten or more years by continuing appointment.

 

·          Allows hearing officers to be paid for mileage expenses up to the amount permitted for county employees.

 

·          Allows JPs pro tempore and hearing officers to perform marriages.

 

·          Defines hearing officers as hearing officers for small claims divisions who are appointed by a presiding judge upon recommendation of a JP.

 

·          Defines Justices of the Peace pro tempore as JPs pro tempore appointed by the presiding judge of the Superior Court in a county if needed.

 

·          Makes technical and conforming changes.
