SB 1142 gives adult surveillance officers peace officer status, as well as, outlines the powers, duties and qualifications for adult surveillance officer status.

History

Current statute (A.R.S. § 28-454) stipulates that a peace officer may request, by filing an affidavit, that persons be prohibited from accessing their personal information, such as a residential address or telephone number that is contained in public records. The affidavit must state the reasons the peace officer reasonably believes that their safety or that of another person is in danger and that redacting the residential address and telephone number from the department's public records will serve to reduce the danger. SB 1142 provides all adult surveillance officers with some of the same protection and authority that is granted to peace officers including:

Ø Charging a person who assaults an adult surveillance officer with aggravated assault.

Ø Allowing surveillance officers to make arrests without warrants if probable cause exists.

Provisions

· Gives adult surveillance officers peace officer status.

· Requires adult surveillance officers to meet the same qualifications and use the same procedures for appointment, salaries and expenses as used by adult probation officers.

· Stipulates that under the direction of the chief probation officer, an adult surveillance officer shall:

Ø Exercise supervision and observation over persons sentenced to probation.

Ø Report to the court if the probationer engages in conduct constituting an offense.

Ø Monitor the payment of restitution and probation fees, and if the probationer fails to pay restitution or fees, the adult surveillance officer shall bring the probationer before the court.

Ø Serve warrants, make arrests and bring before the court persons who are under suspended sentence or who have violated the terms of probation.

· Specifies that an adult surveillance officer shall obtain, assemble and report information to the courts concerning the conduct of persons who are sentenced to probation.

· Makes other technical and conforming changes.
