|
SB 1105 requires planning agencies, zoning agencies and commissions of local governments to provide affected school districts with a copy of the plan or amendment, and notice of any public hearing regarding a general or comprehensive plan development or amendment.
Current statute (A.R.S. § 9-461.05) stipulates that each planning agency shall prepare, and the legislative body of each municipality shall adopt, a comprehensive, long-range general plan, which includes a statement of community goals, development policies, maps, any necessary diagrams and text setting forth objectives, principles, standards and plan proposals for the development of the municipality. In addition, each county board of supervisors is required to adopt a comprehensive long-term county plan. The plans may include maps, charts or graphs. The process for drafting, approval and administration of a city general plan is outlined in statute under A.R.S. Title 9, and the requirements for a county comprehensive plan are outlined in statute in A.R.S. Title 11.
· Requires local governing bodies, when developing or amending their general plans, to consult with, advise and provide opportunity for comment by the School Facilities Board.
· Stipulates that at least 60 days before the general plan or a portion, element or major amendment of a general plan is adopted, the local governmental planning agency must transmit a copy of the general plan to the superintendent of each affected school district.
· Requires the counties and municipalities holding public hearing proceedings involving rezoning of land that is located within or adjacent to a school district, to send copies of the public hearing notice by first class mail to the superintendent of each affected school district.
· Requires the executive director of the School Facilities Board (board) to notify each school district superintendent by first class mail of all actions and hearings of the board that affect the school district.
· Makes other technical and conforming changes
