SB 1058 allows a state agency director to convey real property to a school district or charter school without a public sale if the conveyance is considered to be in the public interest and the real property will be used for a specific purpose in the public interest.
Current statute allows the director or other chief administrative officer of a state agency to dispose of real property or any right, title or interest in real property if the agency director determines that the real property is no longer needed or used for public purposes for that agency. Unless the property is subject to a right of reversion to a previous owner or the previous owner’s successors in interest, the agency director may convey the real property to an agency of the federal government, to another Arizona agency or to any county, municipality or other political subdivision of the state. Such a conveyance replaces a public sale if the agency director determines that the conveyance of the real property is in the public interest and will be used for a specific purpose in the public interest. The agency receiving the real property must pay the transferring agency based on a current appraisal establishing the fair market value of the property to be conveyed.
SB 1058 allows a district or charter school to buy real property from another agency at a price based upon the fair market value as determined by a certified real estate appraiser within the previous 180 days.
· Allows the state agency director to convey real property to a school district or charter school in Arizona without a public sale if the conveyance of the real property is in the public interest and will be used for a specific purpose in the public interest.
· Declares that the appraisal must have been prepared within the previous 180 days by a certified real estate appraiser establishing the fair market value of the property to be conveyed.
