year/up to $150,000 fine).

· Defines the terms reencoder and scanning device.
· Makes the use of a scanning device or reencoder a Class 6 felony if the use is:
Ø Without the permission of the credit cardholder.
Ø With intent to defraud the cardholder, credit card issuer or merchant.
