SB 1052 creates the crime of unlawful use of a scanning device or reencoder and makes the unlawful use of a scanning device or reencoder a Class 6 felony (1 year/up to $150,000 fine).

History

Current Arizona law relating to credit card fraud prohibits theft of a credit card, obtaining the card by fraudulent means, forgery of a credit card, fraudulent use of a credit card and credit card transaction record theft.

 

Provisions

·          Defines the terms reencoder and scanning device.

·          Makes the use of a scanning device or reencoder a Class 6 felony if the use is:

Ø      Without the permission of the credit cardholder.
