SB 1009 authorizes the construction of a victims’ rights memorial in the Wesley Bolin plaza and establishes procedures to complete this project.

 

Current Status

SB 1009 passed the Retirement and Government Operations Committee unamended. On 4/10/02, it was put on the consent calendar. Barring no protest, it will be third read.

 

History

Victims’ rights are established and defined in title 13, chapter 40 of Arizona statute and article 2, section 2.1 of the Arizona State Constitution. Victims of crime have the right to justice and due process in that they must be treated with fairness, respect and dignity and they must be free from intimidation, harassment and abuse throughout the criminal justice process. The Arizona victims’ rights program, which is part of the criminal division of the Attorney General’s Office, assists and monitors governmental entities that deal with victims’ rights.

 

The United States Supreme Court established victims’ rights in the Victims of Crime Act of 1984. This act also established the Office for Victims of Crime (OVC) and the Crime Victims Fund (fund). The OVC works to provide support and help victims of crime to heal. The OVC administers the fund, which is created from fines and penalties paid by federal criminal offenders, to provide money to individual states for victim assistance and compensation programs. Other victim resources include the over 4,000 victim service agencies in the United States, which includes domestic violence shelters, children’s advocacy centers and rape treatment programs.

 

As part of the 2001 Victims’ Rights rally, a tree was planted for the memory of crime victims in the Wesley Bolin Plaza.

 

Provisions

·          Authorizes a victims’ rights memorial to be constructed in the Wesley Bolin plaza.

 

·          Ensures that the state will not provide fund-raising, state funds or public monies for this project and requires it to be completed within two years after this act’s effective date.

 

·          Requires design, dimensions and location proposals to be reviewed by the Department of Administration (DOA), which will submit their review and recommendations, including maintenance suggestions, to the legislative governmental mall commission for their review.

 

·          Authorizes the legislative governmental mall commission in consultation with DOA to approve final design, dimensions, location and maintenance requirements with recommendations made by the historical advisory commission.

 

·          Requires that a contract be entered into with DOA to specify the design, dimensions, location, maintenance, contractors, subcontractors and verification of the employees’ insurance and the state’s indemnification against liabilities before the memorial’s construction.

 

·          Repeals this act January 1, 2006.
