HB 2690 establishes a study committee on Native American issues for the purpose of examining current state laws and policies that impact Native Americans and proposing changes that would address the needs and concerns facing Native Americans. 

 

Current Status

HB 2690 passed the Native American Affairs Committee unamended.

 

Provisions

·          Establishes a Native American study committee consisting of the following members:

·          Three members of the House of Representatives, appointed by the Speaker of the House, one of whom shall be designated co-chairman.  No more than two of these members can be from the same political party.

·          Three members of the Senate, appointed by the President of the Senate, one of whom shall be designated co-chairman.  One of these members must be from the Senate appropriations committee and no more than two of these members can be from the same political party.

·          The director of the Arizona Commission of Indian Affairs, or the director’s designee.

·          One member of the Intertribal Council of Arizona who is appointed by the Speaker of the House.

·          One member from each of the 21 Indian nations or tribes of this state who are designated by their tribal chairman, tribal governor or tribal president.

·          A representative of the urban Indian community who is appointed by the Speaker of the House.

·          The director of the Department of Economic Security or the director’s designee.

·          The director of the Department of Revenue or the director’s designee.

·          The superintendent of pubic instruction or the superintendent’s designee.

·          The director of the Department of Transportation or the director’s designee.

·          Mandates that the committee shall:

·          Examine current state laws and policies that impact Native Americans and identify changes that would improve the status of Native Americans.

·          Prioritize these changes and prepare draft legislation for the 46th Legislature, first regular session.

·          Compare and review state and national studies as well as studies conducted by private entities and Native American nations or tribes that address the needs and concerns facing Native Americans, focusing on the fiscal impact that would occur from recommended changes to the laws of this state.

·          Take testimony from members of Indian nations or tribes of this state, including urban Indians and the public at large, regarding the needs of Indian communities.

·          Prepare a summary, on or before November 29, 2002, of the findings and conclusions of the committee and prepare draft legislation to implement these findings and conclusions.

·            Finalize draft legislation on or before December 13, 2002.

·          Allows the committee to use the services of the legislative staff and staff provided by the Departments of Revenue, Education, Transportation and Economic Security as required.

·          Requires the committee to submit a written report of its findings and recommendations on or before December 31, 2002 to the following people:

·          The Speaker of the House of Representatives.

·          The President of the Senate.

·          The Governor.

·          The Secretary of State.

·          The director of the Arizona State Library, Archives and Public Records.

·          Each of the 21 Indian nations and tribes of this state.

·          States that the members are not eligible to receive compensation but may be eligible for reimbursement of specific expenses.

·          Repeals this act from and after December 31, 2002.
