HB 2567 requires that a person who interferes with the official duties of a law enforcement officer by biting, scratching, spitting or transferring blood or other bodily fluids on or through the skin or membranes of a law enforcement officer be subject to a test for Human Immunodeficiency Virus (HIV), common blood borne diseases, or other specified diseases, for which there are reasonable grounds to believe an exposure occurred.

 

History

Currently, only a person who is charged in a criminal complaint for interfering with the official duties of a law enforcement officer, correctional service officer, detention officer, private prison security officer or firefighter by biting, scratching, spitting or transferring blood or other bodily fluids on or through the skin or membranes of the person is subject to a court order requiring a test for HIV, common blood borne diseases, or other specified diseases, for which there are reasonable grounds to believe an exposure occurred

 

Provisions

§         Requires that a person who interferes with the official duties of a law enforcement officer by biting, scratching, spitting or transferring blood or other bodily fluids on or through the skin or membranes of a law enforcement officer be subject to a court order requiring a test for HIV, common blood borne diseases, or other specified diseases for which there are reasonable grounds to believe an exposure occurred.

§         Makes technical and conforming changes.
