History

A.R.S. § 23-1302 stipulates that no person shall be denied the opportunity to obtain or retain employment because of nonmembership in a labor organization, nor shall the state or any subdivision thereof, or any corporation, individual, or association of any kind enter into an agreement, written or oral, which excludes a person from employment or continuation of employment because of nonmembership in a labor organization.

Provisions

·          Defines assist, promote or deter union organizing; contractor; employer; funds; political subdivision; and property.

·          Prohibits a political subdivision from using funds to reimburse contractors for any costs incurred to assist, promote or deter union organizing and requires a contractor to maintain sufficient records to show that no reimbursement from political subdivision funds has been sought to support or oppose union organizing.

·          Stipulates that the funds prohibition does not apply to a fixed-price contract or to any other arrangement by which the amount of the payment of funds from a political subdivision does not depend on the costs incurred by the contractor.

·          Outlines how a contractor receiving funds from a political subdivision shall account for the funds.

·          Stipulates that a contractor of a political subdivision shall not assist, support or oppose union organizing by employees working on a service contract, including a public works contract, for the political subdivision.

·          States that an employer conducting business on the property of a political subdivision shall not use to the property to hold a meeting with any employees or supervisor to support or oppose union organizing, however, the property may be used by the general public for meetings if the property is equally available and free of charge.

·          Stipulates that a public employer who receives funds from a political subdivision can not use the funds to support or oppose union organizing, also, any public official who knowingly uses funds to support or oppose union organizing is liable to the political subdivision for the amount of the funds used.

·          Prohibits a private employer, in any calendar year, who receives funds from a political subdivision in excess of $10,000 from using its funds to support or oppose union organizing.
