HB 2545 mandates that the cumulative risk and effect of any proposed changes in permitting, facilities or discharges be considered or evaluated in relation to the aquifer protection program, the Arizona pollutant discharge elimination system program, state air pollution control, county air pollution control, regulation of solid waste, and hazardous waste management.   A proposed strike-everything amendment limits the term of temporary permits and allows DEQ to set renewal fees.

 

The proposed strike-everything amendment contains the following provisions:

 

·          DEQ may issue a temporary form of a permit that is initially valid for up to two years and can be renewed for up to five successive one year periods.

·          There is a temporary permit renewal fee determined by the director;  the renewal fee amount  doubles each year until expiration.

·          If a corporation or business that holds a temporary permit has any change in ownership that involves twenty per cent or more of the equity or debt liability of the corporation or business, the temporary permit expires and a the new owner must apply for a new permit.

·          Any temporary permit issued before the effective date of the act expires on December 31, 2004.
