HB 2532 exempts experimental schools from the School Facilities Board (SFB) minimum square footage adequacy requirements.

 

History

The SFB provides funding to school districts for new construction when existing school facilities require more pupil space.  In determining space requirements, the SFB refers to the minimum square footage per pupil guidelines established for schools in A.R.S. 15-2011.  The SFB is allowed to modify both the square footage requirements and the amount of monies required to cure a square footage deficiency for extraordinary circumstances.  Extraordinary circumstances are defined in statute as the number of pupils served by the district, geographical factors and alternative grade configurations. In measuring the square footage per pupil adequacy requirement, the SFB uses the most recent 100th day average daily membership, a square footage estimate and considers all total space available in a school district.

 

Provisions

·          Excludes the square footage of experimental schools established by a common school district and a union high school district, in conjunction with a community college district, from the SFB’s minimum adequate gross square footage requirements, if the following requirements are met:

§         The experimental school is located on land that was formerly designated as state trust land

§         The applicable school districts have annexed the land where the experimental school is constructed

§         The districts have entered into an intergovernmental agreement to construct and operate the experimental school.  Requires the intergovernmental agreement to address the school’s use by students in community college, elementary and high school during discreet and separate times of the day and week.

§         The experimental school is constructed within five years of the sale of the state trust land.

§         The school enrollment shall not exceed 1,200 common school or high school pupils at any time.

§         States that the SFB shall not pay for the construction of an experimental school if any school district that is eligible for a new school, due to a square footage deficiency, did not receive approval for a school.

§         Repeals the act on July 1, 2007.
