A strike-everything amendment will be offered in the Appropriations Committee with the following provisions:
The strike-everything amendment to HB 2520 requires Medicaid reimbursements for pupils with disabilities to be expended for special education and related services. These monies shall be included in the Biennial Special Education Cost Study completed by the Arizona Department of Education.
The Joint Legislative Committee on Special Education and Regulations (Committee), established in Laws 1999, Chapter 67 was created to:
1. Make recommendations for possible modifications to the current special education finance formulas and system.
2. Examine the potential impact of the new federal Individuals with Disabilities Education Act regulations including any regulations associated with suspension or expulsion of children with disabilities.
3. Examine and report recommendations regarding the formation of a Group B special education risk management pool.
The Committee made a number of legislative recommendations. HB 2523 is the result of two of these recommendations.
· Requires Medicaid reimbursements to a school district or charter school for direct services to Medicaid eligible pupils with disabilities to be expended solely for special education and related services and requires these services to be accounted for separately.
· Requires these expenditures to be included in the Special Education Cost Study conducted biennially by the Arizona Department of Education.
