HB 2473 requires the Director of the Department of Corrections (ADC), before establishing a minimum or medium security correctional facility, to release a request for proposal or invitation to bid for a private correctional facility. Additionally, HB 2473 stipulates that the Director shall establish the private facility if certain criteria are met.

 

History

Current statute stipulates that, on publication, any request for proposals for the establishment of private prison facilities shall be provided to the Joint Legislative Budget Committee (JLBC) for review.  Additionally, current statute stipulates that a proposal shall not be accepted unless it offers cost savings, determined by the standard cost comparison model for privatization established by the Director of the Department of Corrections and the Governor's Office for Excellence in Government.

 

Provisions

·              Requires the Director of ADC, before establishing a minimum or medium security correctional facility, to release a request for proposal or invitation to bid for the establishment for a private incarceration facility.

·              Stipulates that the Director of ADC shall establish the private facility if the Director receives an acceptable proposal and makes the determination that the contractor will provide services of similar or better quality to that of the state. Outlines the factors that the Director must consider in making the determination to establish either a state or private facility.

·              Makes other technical and conforming changes.
