HB 2407 allows a city, town or county to use an alternative procedure to employ a technical registrant or enter into a contract for work on a public building or structure according to policies and procedures prescribed in a procurement code adopted by that city, town, or county.
Current Status
HB 2407 failed to pass the Counties & Municipalities Committee.
Current statute stipulates that whenever a city, town, or county enters into a contract with a technical registrant for an amount of more than $500,000 or an architect for an amount of more than $250,000, the city, town, or county may procure design services, construction and construction services, as applicable, under any of the following project delivery methods: design-bid-build; construction-manager-at-risk; design-build; or job-order contracting.
Additionally, current statute stipulates that whenever a city, town, or county enters into a contract with a technical registrant for an amount less than $500,000 or an architect for an amount less than $250,000, the city, town, or county may employ a technical registrant by direct selection or by the public competition process as follows: First, encourage persons or firms to annually submit a statement of qualifications and experience. Next, a selection committee, initiated by the city, town or county, shall then evaluate the statements of qualifications and experience and select a short list of at least three of the persons or firms deemed to be the most qualified to provide the services required. Lastly, after the short list is selected, the city, town, or county shall enter into negotiations for a contract with the most qualified person or firm.
