HB 2391 establishes the Governor’s Advisory Planning Office and Board as a statewide land use planning advisor, which shall develop and adopt guidelines, furnish information regarding plans and review planning and zoning.  It also states that the Governor’s Advisory Planning Office and Board’s findings and opinions are advisory only and prescribes the members of the Governor’s Advisory Planning Board.

 

History

The Governor and the state, county, local and regional entities currently make decisions on land use.  Land use planning includes any zoning or other decisions about what land will be used for.  The Growing Smarter Commission was established by the Growing Smarter Act of 1998, which reforms the community planning and rezoning processes in cities, towns and counties by adding new growth-conscious elements to community plans and requiring proposed changes to those plans.  The Act requires counties, cities and towns to provide greater opportunities for citizens to participate in the development of plans. The Act requires a super-majority vote for the adoption of major amendments to community plans. Also, the Act improves the coordination of State Trust Land planning with community planning.  Governor Hull has also appointed the Growing Smarter Oversight Council, which monitors the effectiveness of Arizona's growth management statutes and offers suggestions to Legislation on how the statute may be improved.

 

 

Provisions

·          Creates the Governor’s Advisory Planning Office (Office) in the office of the Governor.

 

·          Authorizes the Office to act as a statewide advisor to the Governor, state, county, local and regional entities on land use planning.

 

·          Requires the Office to develop and adopt guidelines for the mandatory elements of land use planning.

 

·          Allows the Office, upon request, to review any land use decisions and report their findings and opinions.

 

·          States that the Office’s  findings and opinions are advisory only.

 

·          Establishes a nine member Governor’s Advisory Planning Board.

 

·          Mandates the annual election of a chairperson, requires the Board to meet at least one time a year and specifies terms of office.

 

·          Appropriates $200,000 from the commerce and economic development commission fund and $50,000 from the interest earned by the greater Arizona development authority revolving fund in fiscal year 2002-2003.

 

·          Exempts appropriations from lapsing.
