HB 2349 establishes procedures for convicted persons to pay the costs of deoxyribonucleic acid (DNA) testing.

 

Current Status

HB 2349 was amended in the Judiciary Committee with a technical change.  The Judiciary amendment was adopted in the Committee of the Whole.

 

History

 Within 15 days after a person is convicted or adjudicated delinquent for public sexual indecency, sexual abuse, sexual conduct with a minor, sexual assault, child molestation, continuous sexual abuse of a child, incest or a person who fails to accurately register as a sex offender, the person must submit to a blood sample test conducted by a county probation department.  Within 30 days after the arrival of a person accepted for interstate parole supervision, the person must submit to a blood sample test and pay for the costs of DNA testing.

 

Provisions

·          Specifies that a person required to submit to DNA testing must pay the cost of testing to the clerk of the court, who shall transmit the monies to the county treasurer who shall transmit the monies to the state treasurer for deposit in the Arizona Deoxyribonucleic Acid Identification System Fund.

·          Clarifies that money collected for DNA testing is included in the Arizona Deoxyribonucleic Acid Identification System Fund.

·          Makes technical and conforming changes.

 

Amendments

HB 2349 was amended in the Judiciary Committee as follows:

§         Changes an incorrect reference.

The Judiciary amendment was adopted in the Committee of the Whole.
