HB 2348 requires the Department of Public Safety (DPS) to transfer title of land formerly used as the Arizona Law Enforcement Training Academy (ALETA) to the Arizona Department of Corrections (ADC).

 

Current Status

HB 2348 was amended in the Judiciary Committee with a clarifying change.  The Judiciary Committee amendment was adopted in the Committee of the Whole.

 

History

The Correctional Officer Training Academy (COTA) is responsible for conducting pre-service training for all ADC correctional officers.  In January 1986, COTA began conducting training at the site of the ALETA, located on approximately 43 acres of land in the Tucson Mountains.  In July 1996, the Arizona Peace Officer Standards and Training Board (POST) relocated the ALETA training program to the Phoenix Training Academy and the Department of Corrections assumed full management responsibility for the ALETA site in Tucson.  POST recently adopted a resolution approving a legislative transfer of title in the ALETA property and facility from the DPS, for the benefit of POST, to ADC for COTA.  The adopted resolution provided the recommendation that if ADC discontinues basic correctional officer training at the site POST may reacquire it or if the property is sold the proceeds should be divided between the Peace Officers Training Fund and the State General Fund in the same proportions as the original contributions made in acquiring the property.

 

 

Provisions

·          Requires DPS to transfer title of the land formerly used as the Arizona Law Enforcement Training Academy to ADC.

·          Provides that if ADC sells or leases the property after the title transfer, the proceeds will be distributed as follows:

Ø      The greater of 53.66 percent of the proceeds or fair market value to the Peace Officers’ Training Fund.

Ø      46.34 percent to the State General Fund.

 

Amendments

HB 2348 was amended in the Judiciary Committee as follows:

§         Clarifies that 46.34 percent of the proceeds from the lease or sale of the property or 46.34 percent of the fair market value, whichever is greater, shall be deposited in the state general fund.

The Judiciary Committee amendment was adopted in the Committee of the Whole.
