HB 2346 authorizes the Department of Public Safety (DPS) to charge federal firearms licensees a fee for performing background checks.

 

Current Status

HB 2346 passed the Judiciary Committee unamended.

 

History

DPS maintains an instant background check system, referred to as the Arizona Firearms Clearance Center, to conduct federal background checks to determine whether a purchaser or transferee is a felon, a fugitive from justice, or is disqualified from lawfully possessing a firearm by any federal or Arizona law.  Background checks do not have to be performed for private firearm sales or transfers, which are not subject to federal or Arizona law.

 

Provisions

·          Authorizes DPS to charge federal firearms licensees a fee prescribed by the Director of DPS to perform background checks on persons who purchase or redeem firearms from a federally licensed firearms dealer.

·          Makes technical and conforming changes.
