HB 2346 authorizes the Department of Public Safety (DPS) to charge federal firearms licensees a fee for performing background checks.

 

History

DPS maintains an instant background check system, referred to as the Arizona Firearms Clearance Center, to conduct federal background checks to determine whether a purchaser or transferee is a felon, a fugitive from justice, or is disqualified from lawfully possessing a firearm by any federal or Arizona law.  Background checks do not have to be performed for private firearm sales or transfers, which are not subject to federal or Arizona law.

 

A strike-everything amendment will be offered to HB 2346 with the following provisions:

·          Repeals DPS authority to conduct federal firearms background checks.

·          Requires the Director of DPS to notify the Federal Bureau of Investigation (FBI) that the FBI will have to take over federal firearms background checks as of the effective date of this act.
