HB 2326 allows a unified school district in the final year of a budget override to budget for the full amount of the override and not phase-down per statute, and applies this retroactively to July 1, 2000.
HB 2326 was amended in the Education Committee to require the county school superintendent to notify a school district with an override within three years of the override’s expiration to adjust the budget to reflect the final two-year statutory phase down requirements, and made additional clarifying changes.
Current statute allows a school district to exceed the Revenue Control Limit (RCL) under certain circumstances. One of the options includes allowing a school district to exceed the RCL if the proposed increase will be fully funded by revenues other than a tax levy on the taxable property within the school district. The funding sources for the budget overrides for this particular type of override are derived from federal monies or local carryforward monies only. Additionally, statute requires a school district with this type of override to use any available revenues to reduce its local primary property tax rate to zero before the budget override can take effect. The maximum budget override amount is 10% of the RCL, notwithstanding any supplemental guidelines.
Current statute requires school districts to phase down budget override amounts during the last two years of an override. During the second to last year, the district receives two-thirds of the original percentage approved for the budget override, reducing to one-third of the original percentage in the final year.
· Eliminates the two-year phase-down period for a budget override for a unified school district that is in the final year of a budget override in FY 2001-02 under the following conditions:
· The original overrides were for the maximum statutory amount and approved by the voters.
· The voters approved the overrides by a margin of 75% or more.
· The school district failed to request to renew either budget override.
· Contains a retroactive date of July 1, 2000.
