HB 2315 would require DEQ to consider whether a proposed permit for siting a solid waste or hazardous waste facility would have or add to a disparate impact on a racial or ethnic population.

A proposed strike-everything amendment establishes a study committee on this issue.

Current Status

The Environment Committee adopted a Strike-Everything Amendment that would establish a Joint Legislative Study Committee on Cumulative Impacts of Siting Facilities Requiring Environmental Permits.

HB 2315 passed the Counties & Municipalities Committee unamended.

History

The text of the printed bill is the same as HB 2612 (2000) and HB 2457 (2001).

Provisions  (strike-everything amendment adopted by the Environment Committee)

·              The study committee will be made up of 17 persons: DEQ, DHS, Department of Insurance, two Representatives, two Senators, two city, two county, organization that represents entities that receive environmental permit, two homeowners, transportation organization, fire department, planning and zoning expertise.

·              The committee will study and review the process for planning, zoning, siting, expansion and modification decisions relating to facilities that are required to obtain environmental permits.

·              The committee will make recommendations on any statutory, regulatory or administrative process revisions.

·              The committee is required to report on its findings and recommendations by December 1, 2002.
