HB 2289 creates the Joint Study Committee on State Funding of the Court System.

 

Current Status

HB 2289 was amended in the Judiciary Committee to add members to the Joint Study Committee on State Funding of the Court System.  HB was amended in the Retirement and Government Operations Committee to add one member who is a public defender and who is appointed by the Arizona attorneys for criminal justice and change the report and repeal dates.  The Judiciary Committee amendment and the Retirement and Government Operations Committee amendment were adopted in the Committee of the Whole and the bill was further amended to add two justices of the peace to the Joint Study Committee on State Funding of the Court System.

 

History

Currently in Arizona, the courts are funded by a combination of state, county, and federal grant monies.  The amount the courts receive from each entity varies.

 

Provisions

§         Establishes the 21-member Joint Study Committee on State Funding of the Court System.

§         Requires the Committee to:

·        Review state funding of the Arizona court system.

·        Make recommendations as to which components of the judicial system should be funded by the state.

·        Recommend a plan for state funding of the judicial system including the time period for implementation and the source of revenues for increased state responsibilities.

·        Develop a plan for the implementation of a statewide indigent defense office.

§         Mandates that the staff of the County Supervisors Association and the Administrative Office of the Courts provide technical assistance to the committee.

§         Requires the Committee to submit a report to the Governor, the President of the Senate, the Speaker of the House of Representatives, the Chief Justice of the Supreme Court, the Association of County Supervisors and the Arizona League of Cities and Towns by June 30, 2003.

§         Requires the committee to provide copies of the report to the Secretary of State and the director of the Arizona State Library, Archives and Public Records.

§         Contains a delayed repeal date of January 1, 2004.

 

Amendments

HB 2289 was amended in the Judiciary Committee as follows:

§         Adds the Chief Justice of the Supreme Court or designee, the Administrative Director of the Administrative Office of the Courts or designee, a presiding judge, one person from a rural and one from an urban county who is appointed by the county supervisor’s association, a clerk of the court and one county attorney appointed by the Arizona Prosecuting Attorneys Advisory Council to the Joint Study Committee.

HB 2289 was amended in the Retirement and Government Operations Committee as follows:

§         Adds one member who is a public defender and who is appointed by the Arizona attorneys for criminal justice and changes the report and repeal dates.

The Judiciary Committee amendment and the Retirement and Government Operations Committee amendment were adopted in the Committee of the Whole and the bill was further amended to do the following:

§         Adds a justice of the peace appointed by the President of the Senate from a county with less than 500,000 people to the Joint Study Committee.

§         Adds a justice of the peace appointed by the Speaker of the House of Representatives from a county with more than 500,00 people to the Joint Study Committee.
