HB 2288 modifies the way ordinary disability is computed within the Public Safety Personnel Retirement System (PSPRS) from a percentage of the member’s average monthly benefit compensation before termination of employment, based on a graduated scale of years of service, to actual years of service.

HB 2288 passed the Retirement and Government Operations Committee unamended.

 

History

A member is eligible for an ordinary disability pension if the member’s employment is terminated before the member’s normal retirement date for reasons of ordinary disability.  Ordinary disability means a physical condition, which the local board determines will prevent an employee totally and permanently from performing a reasonable range of duties within the employees department. Ordinary disability is also a mental condition, which the local board determines will prevent an employee totally and permanently from engaging in any substantial gainful activity.  Ordinary disability shall be based on medical evidence by a doctor or clinic appointed by the local board and determined satisfactory by the board.

 

The ordinary disability benefit is a percentage of normal retirement based on years of credited service as follows:

Less than seven years of service                                                                                    25%

Seven or more years of service, but less than 14 years                                       50%

14 or more years of service, but less than 20 years                                                        75%                            

 

 

Provisions

·          Establishes that ordinary disability shall be computed by dividing the PSPRS member’s actual years of credited service, not to exceed 20 years of credited service, by 20.
