As Passed the House

HB 2282 removes the element of economic loss from the crime of identity theft by defining the terms another person and other person for purposes of the crime of identity theft as a person whose personal identifying information is taken, whether or not the person actually suffers economic loss as a result.

History

ARS 13-2001 formerly defined victim as a person whose personal identifying information is taken or used without consent, whether or not an economic loss occurs.  Laws 2001, chapter 113 amended Arizona Revised Statutes section 13-2001 to exclude the definition of the term victim because the term was not used in the section.

Provisions

·        [d1] States that a person commits the crime of identity theft by taking another person’s identifying information, whether or not the person actually suffers economic loss as a result.
