HB 2281 establishes the Arizona Airspace Commission (Commission) for the purpose of studying airspace issues, including flight patterns, in this state. 

 

Current Status

HB 2281 failed to pass in the Military, Veterans’ Affairs & Aviation Committee.

 

A same subject strike-everything amendment to HB 2281 will be offered in the Military, Veterans’ Affairs & Aviation Committee.  

 

Provisions of the proposed strike-everything amendment:

·          Establishes the Arizona Airspace Commission consisting of the following members:

·          The chairperson of the Senate Transportation Committee, or its successor committee.

·          The chairperson of the House of Representatives Military, Veterans’ Affairs & Aviation Committee, or its successor committee.

·          A Senate President appointed person from a county that has a population of more than 1,500,000 persons and is an airport manager.

·          A Speaker appointed person from a county that has a population of 500,000 persons or less and is an airport manager.

·          A Speaker appointed person from a city or town that has a population, in the incorporated area of the city or town, of more than 60,000 persons who may be a private pilot, but may not be employed in any fashion within the aviation industry.

·          A Senate President appointed person from a city or town that has a population, in the incorporated area of the city or town, of 10,000 persons or less who may be a private pilot, but may not be employed in any fashion within the aviation industry.

·          The Department of Transportation’s assistant director for aeronautics.

·          A Governor appointed person who is a member of the Federal Aviation Administration.

·          A Senate President appointed person from a major airline with international flight operations originating and departing in this state.

·          A Speaker appointed person from a major airline with flight operations originating and departing in this state.

·          A Governor appointed person from a regional airline with flight operations in this state. 

·          A Speaker appointed person from a flight training school with single engine and multi-engine part 61 flight operations based in this state.

·          A Senate President appointed person who is a member of the Aircraft Owners and Pilots Association or Arizona Business Aviation Association.

·          The Commander of Luke Air Force Base.

·          The adjutant general of the National Guard in this state.

·          Establishes that in even numbered years the House of Representatives member of the Commission shall serve as chairperson of the Commission and in each odd numbered year the Senate member of the Commission shall serve as Commission chairperson.

·          Outlines the issues that the Commission will study which include:

·          Air quality.

·          Noise levels.

·          Population growth.

·          Flight patterns - both arrivals and departures.

·          Feasibility studies for rural air service, including route availability and pricing.

·          The impact on the airspace in Arizona of establishing new or expanding existing airport locations.

·          Military flight operations.

·          Public safety flight operations.

·          Air evacuation operations.

·          Recreational airports. 

·          Requires the Commission to compile a report on airspace on or before December 31 of each year that will be posted to the Arizona Legislative Information System for public access and submitted to the following:

·          The Governor.

·          The President of the Senate.

·          The Speaker of the House of Representatives.

·          The Arizona Department of Transportation.

·          The Federal Aviation Administration.

·          Members of Congress from this state.

·          All primary and secondary airports in this state.

·          All airlines with flight operations in this state.

·          All flight training schools operating within this state.

·          The National Business Aviation Association.

·          The Aircraft Owners and Pilots Association.

·          The State Transportation Board.

·          Requires the Commission to submit airspace recommendations for this state to the Federal Aviation Administration Western-Pacific Region and Southwest Region for review and consideration for modifications of airspace in this state.
